CUSTOMER PORTAL – LOGIN TERMS

  1. Scope and Business Use. This customer portal is intended exclusively for business customers acting in the course of their commercial or professional activities. Access is personal, login credentials are strictly confidential and must not be shared with third parties. Portal use is limited to viewing chip database and associated technical data provided by fluidXlab.
  2. Nature of the Portal and Disclaimer. The portal and all content, technical data, analyzes, and processing results are provided for information purposes only, on an “as is” and “as available” basis, without guarantee of correctness, completeness, suitability, commercial usability, fitness for a particular purpose, uninterrupted availability, specific performance, or error-free operation.
  3. Limitation of Liability. fluidXlab is not liable for damages arising from slight negligence. Liability for intent, gross negligence, or mandatory statutory liability remains, limited to foreseeable, contract-typical damages and capped at 100€ per incident. Indirect or consequential damages (including loss of profit, data, production, business interruption, or other economic losses) are excluded to the maximum extent permitted by law.
  4. Customer Responsibility and Risk Allocation. The customer remains solely responsible for independent verification of all portal data/results, suitability assessment, and all business, technical, and economic decisions taken on that basis.
  5. Mandatory Personal Data Processing. Name, job title, email address, and login-related authentication/security data are processed based on Art. 6(1)(b) GDPR for contract performance. Retention follows business relationship duration, statutory obligations, and legal-claim requirements.
  6. Optional Monitoring and Analytics. For analytics and portal improvement, fluidXlab may process login times, session duration, click paths, and IP addresses. This processing is optional and based only on consent under Art. 6(1)(a) GDPR. Consent can be refused or withdrawn at any time without affecting portal access.
  7. Data Hosting. Data is hosted on AWS servers located within the European Union with appropriate technical and organizational safeguards.
  8. Rights of Data Subjects. Data subjects have rights to access, rectification, deletion, restriction, objection, and withdrawal of consent, and may lodge complaints with a competent supervisory authority.
